about us

Photoasia made it's first sales from Bangkok in 1998, and has since moved to Melbourne to become Australia's largest photo library specializing in images of Asia. Our diverse collection has evolved over eight years of travelling, living and photographing different regions of Asia. We also source from 19 of the finest photographers currently living there.

This website has been created by a skilled and innovative team who will be frequently uploading new developments and images. We aim to improve and expand the functionality and look of the site - in the near future we will have user login, online credit card payments, FTP download and more.

At present, we licence our images mainly to advertising agencies, travel and tour companies, editorial publications, publishers, educational and government departments.

Photoasia is wholly owned and operated by Sophie Loft and Tim Loft. Both studied photography at RMIT and have been working as photographers for over 9 years.

about our image collection

The Photoasia library stores over 15,000 images of it's own on file covering a wide range of subjects from ten countries in Asia. The first 650 images on line cover Cambodia, Thailand and Vietnam. (If you can't find what you are looking for on line, please complete a 'Request a custom image search' form). The website will expand to include all of Photoasia's 15,000 images as well as the work from another 19 photographers living throughout Asia. At present, we have access to a selection of over 75,000 inspiring works of art!

Our service is professional and personalised. Different to most other image libraries, we as the photographers see your order through to delivery. You can speak to us directly about the images because we created them.

At www.photoasia.com.au we offer a fast and efficient search integrated website, download of low resolution comping images, light box functionality, on line quote and ordering, and a custom image search.

about steps to licensing images

In making a purchase with Photoasia you are purchasing a license to use an image, not the image itself.

Steps to licensing an image:

1. Go to pricing in the navigation bar, check the price(s) applicable to your project. If this list is not specific enough, complete the 'request a quote' form in orders. You will receive a quote confirmation within one working day (there is no obligation to continue from here).

2. When you are ready to purchase images, complete the 'request an order' form in orders. You can email this or print it out and fax or post it to us.

3. Within one working day you will receive back three things (a) a confirmation of order, (b) an image licensing contract for you to read, sign and fax back to our office, (c) an invoice.

4. Your payment can be made by credit card (Visa, MasterCard and Bankcard), electronic funds transfer or cheque / money order.

5. As soon as payment is made, your image(s) are sent by email (if resolution is under 600k), or your CD by courier (if in Melbourne Metropolitan) or Fed X (country, interstate or overseas).

 

about image licensing

Images are licensed for specific predefined usages, meaning that the client identifies how, where, and to what extent they would like to use an image(s) and Photoasia provides permission to use and/or reprint the image(s). Image license fees are based on the usage as requested. You are typically granted one-time usage rights and you must follow and accept Photoasia’s ‘Image License Terms and Conditions.’ You are not allowed to edit or alter the images unless authorized. By purchasing the license to use an image from Photoasia you are ensured that there is limited usage of the image, you can even request exclusive rights to an image to eliminate any chance of its simultaneous usage by your competitors or other agencies.

1.       Click on the search button in the navigation bar at the top of any page

2.       Enter the keywords (up to three) you want to search in the ‘Keywords search’ box

3.       Click the ‘Go’ button

Your entry will be used to query the image keywords, notes, and category fields for matches. Entries are not case sensitive. Everything you enter is taken exactly as typed. You will only receive a positive result when the matching text contains every single piece of your input. Up to three keywords can be entered at one time, please leave a space between each word.

about image information

Below each search result is a ‘detail’ button with a magnifying glass icon. Clicking on this button will present a separate pop-up window that contains not only an enlarged image but further information about that image such as the country and date the photograph was taken, a short description, photographer credit line and states whether the image has a restricted use.

 

about restricted use images

Many images in the Photoasia collection are restricted for certain types of use (see detail window in search), and restrictions impact image use and licensing. Image restrictions can vary from “not for advertising use” to “not for print use.” An image with ‘restricted use’ applied to it does not necessarily mean that it will apply to your intended use of that image. Images that do not indicate restricted use means only that Photoasia does not have any specific restrictions on file; you must still comply with all laws and third-party rights and restrictions when using such image(s).

 

about lightbox

Below each search result is an ‘add to lightbox’ button with a plus icon. Clicking on this button will send that image to the lightbox, which can then be used to process a quote or order.

To enter the lightbox, click on the ‘view my lightbox’ button. Items you have marked for collection while browsing will be displayed here. While in the lightbox’ you may preview or find information about selected images, deselect specific images from the collection or empty the entire lightbox.

 

about downloading comp images

Photoasia allows users to download low resolution comping images for planning purposes, these images are watermarked. Before you download an image, please read the Terms and Conditions of Use for the photoasia.com.au Website

To download a low resolution comping image, follow these steps:

1.        Click the magnifying glass icon below the image you want to download.

On a PC

2.        Right-click on the enlarged image.

3.        Select Save Picture As…

4.        Save the file to the desired location.

On a Mac

2.        Click and hold on the enlarged image.

3.        Select Download image to disk.

4.        Save the file to the desired location.

 

about image resolution and size

The following is a rough idea of print sizes relative to file size in megabytes. Image files are available in four sizes; low, medium, high and very-high. Images supplied as very-high are drum scanned and can be custom scanned to your requirements. All images are scanned at 300ppi.

about image format

Images from Photoasia in RGB format and not in CMYK format. When an RGB image is converted to CMYK, several parameters must be taken into consideration, including paper stock, four-colour film output device, layout software programs used, types of inks used, and special effects intended by you, the designer. We don't want to make these decisions for you since we'd rather you have the control in deciding exactly how your images are converted to CMYK.

 

about returns

If you have any problems with an image or questions about your order, we urge you to contact us at Photoasia on +613 94814696 (international) to discuss the problem in person or send an email to sales@photoasia.com.au

Generally, returns are not accepted unless there is a technical problem with the image. In those cases replacements or substitutions will be arranged. If for any other reason you need to make a return, Photoasia in its discretion may offer a credit for further image licenses, but under no circumstances shall a full cash refund be granted.

1.  Definitions

In these terms and conditions:

a.        ‘Photoasia’ is the business PHOTOASIA (ABN 14 408 582 237), also known as photoasia.com.au.

b.        'You' means a party who uses the Website or who downloads any Image. If You use the Website or download an Image on behalf of Your employer this definition will include Your employer. You will ensure that any person supplied any Image at Your request will comply with these terms, and You will be personally liable to Photoasia if such person fails to do so, as if such failure were a failure by You.

c.        'Content' means all of the content featured or displayed on the Website, including, but not limited to, Images, and all other text, graphics, photographs, moving images, sound, illustrations and software.

d.        'Image(s)' means Low Resolution Digital Images available for download on the Website and High Resolution Digital Images supplied on CD-ROM to You, subsequent to You filling in a ‘Place an order' form and receiving an Invoice.

e.        'Invoice' means an invoice sent to You in accordance with these Terms and Conditions.

f.         'Low Resolution Digital Image(s)' means low resolution comping images available for downloading from the Website.

g.        'High Resolution Digital Image(s)' means high-resolution images supplied on CD-ROM.

h.        'Reproduction' means any form of colour or black and white copying, publication, distribution or other communication to the public of the whole or part of any Image whether by printing, photography, slide projection (whether or not to an audience), xerography, artist's illustration, layout or presentation, or by electronic, internet, multimedia, digital or mechanical means or by any other means. Reproduction further includes the use the whole or part of any Image in the creation of another picture, which may be partly or completely different from the original Image whether such difference is caused wholly or partly by computer, electronic, digital, mechanical or any other means. "Reproduce" has a corresponding meaning.

i.          'Website' means the whole or any part of the web site pages located at http://www.photoasia.com.au (including the layout of the Website, graphic design elements of the web site pages, underlying code elements, graphics and text.

2.  Limited Liability

You may have certain rights and remedies available to You in relation to the provision by Photoasia of goods and services on the Website under the Australian Trade Practices Act 1974 and similar state and territory legislation in Australia which cannot be excluded, restricted or modified ("Basic Rights"). Except as provided by the Basic Rights:

a.        all other conditions and warranties either express or implied by custom, law or statute are excluded;

b.        the Images we provide and all Content on the Website is provided without any warranties of any kind, either express or implied, other than as we expressly state (for example, we expressly promise that we are entitled to license the Images on the Website);

c.        Photoasia does not warrant that Your access to the Website or the functions contained on the Website will be uninterrupted or error free, that any defects will be corrected or that the Website or the server which stores and submits Content to You via the Website are free of viruses, malicious computer code transmitted on or through the Website or other harmful components;

d.        Photoasia expressly disclaims the accuracy of all descriptions and specifications of any products displayed or viewed through the Website;

e.        Photoasia expressly disclaims the currency, accuracy or completeness of any Content or any information provided by third parties on or through the Website.

Use of the Website is at Your own risk. Subject to these terms, You assume full responsibility and risk of loss resulting from Your downloading, use of, or access to data, files, information, Content, or other material on or through the Website. The Images and all other Content we provide on the Website is all subject to copyright - in Australia and elsewhere - belonging to us and to other people. Your use of the Images or Content we provide or accessible through the Website does not grant You any ownership rights in these items. Except as permitted by law, You may not de-compile, reverse engineer, disassemble or otherwise reduce to human-readable form any software contained on the Website. Prior to purchase or download of any Image from the Website You should read and understand the Image License Terms and Conditions set out below.

4.  Governing Law/Jurisdiction

This Agreement is governed by and interpreted in accordance with the laws of the State of Victoria, Australia, and the parties irrevocably submit to the non-exclusive jurisdiction of the Courts of the State of Victoria, Australia.

2. Grant of License for Image use and Reproduction rights

a.        In consideration of payment by You of the fees itemised on the Invoice, Photoasia grants You a license to use the Image(s) subject to the conditions agreed to by You and listed on the Invoice and the terms and conditions contained herein.

b.        Except as expressly set out in these terms and conditions, You acquire no rights, including without limitation copyright and other intellectual property rights, in the Image(s) other than a license granted in accordance with these terms.

c.        Exclusive Reproduction rights are not granted to You unless specified on the Invoice.

d.        Low-Resolution Digital Images may be used ONLY for PERSONAL, NONCOMMERCIAL use and TEST or SAMPLE use, including COMPS and LAYOUTS. The watermarks may not be removed. The Low-Resolution Images may not be used in any final materials distributed internally or outside of Your company or to the public, including, but not limited to, advertising and marketing materials or any online, or broadcast or other electronic distribution system (except that You may transmit comps digitally or electronically to Your clients for their review), and may not be distributed, sublicensed or made available for use or distribution separately or individually, and as licensee, You are not entitled to grant to anyone else any rights in relation to the Low-Resolution Digital Images.

e.        High-Resolution Digital Images may not be sub-licensed, resold or otherwise made available for use or distribution separately or detached from a product or web page. For example, High-Resolution Digital Images may be used as an integral part of a web page design, but may not be made available for downloading separately or in a format designed or intended for permanent storage or re-use by Website users. Similarly, third parties may be provided with copies of High-Resolution Digital Images (including digital files) as an integral part of work product, but may not be provided with High-Resolution Digital Images or permitted to use High-Resolution Digital Images separately. If such use is required, it is necessary for the third party to enter into a separate license agreement with Photoasia.

f.         When using the Image(s), You may not make or permit any modifications to or alterations of the Image(s) (except for standard colour correction and/or minor cropping for space limitations) unless specifically agreed in writing by Photoasia.

g.        The Image(s) may not be used in a manner which is pornographic, defamatory, unlawful or absent the consent of the model featured in the Image(s).

h.        If an Image featuring a person is used in a manner that implies endorsement, use of, or a connection to a product or service by that model, or a potentially unflattering or controversial subject, You must publish a statement which indicates that the person is a model and is used for illustrative purposes only.

i.          One (1) copy of the Image may be made for backup purposes only, but may be used only if the original Image becomes defective, or is destroyed or otherwise irretrievably lost. Except as specifically provided in this agreement, no Image may be shared or copied.

j.         Upon termination of any license or agreements all High-Resolution Digital Images stored electronically or on CD-ROM must be destroyed.

k.        Two (2) copies of any publication or the relevant sections containing the Reproduction of any Image(s) supplied by or the copyright of Photoasia are to be delivered to Photoasia by You free of charge within thirty (30) days of publication. After such period Photoasia in its discretion may purchase or by other means may obtain or see copies of such publication and shall be recompensed by You for any costs incurred in doing so.

l.          The license hereby granted is expressly subject to the condition that the copyright notice "© 2003 photoasia" or "© 2003 photographers name/photoasia" appears adjacent to any Image sourced from the Website, or such a copyright notice is clearly visible on a credits page or screen. The right to a credit is asserted in accordance with sections 77 & 78 of the Copyright, Design & Patents Act 1988.

m.       Images are not licensed for use in a downloadable or FTP format.

Use of the Images must be in compliance with all applicable laws, including, but not limited to, laws and regulations relating to copyright. Where Photoasia's or its licensor's rights with respect to any Image are adversely affected by any third party, Photoasia reserves the right to terminate any license granted with respect to such Image(s). In the event of such termination, Your sole remedy will be the replacement of such license with a license for alternative Image(s) as determined by Photoasia.

3.  Fees and charges

3.1  Fees

Fees as advised by Photoasia to You may vary per Image depending on a number of factors including but not limited to the period of use, print run, media usage, end user customer, industry, territory and size and position of proposed Reproduction. The prices listed on the Photoasia Website are intended as a guide only and do not represent the actual price of the Image License fee which will be confirmed and itemised on the Invoice emailed or posted to You. In consideration of payment by You of the fees itemised on the Invoice, Photoasia grants You a license to use the Image(s) subject to the conditions agreed to by You and listed on the Invoice.

3.2  Photoasia Accounts

The total amount shown on the Invoice is due and payable by You to Photoasia within thirty (30) days of the date of Invoice. Photoasia will be entitled to charge interest on amounts not so paid at the rate of two point five percent (2.5%) per month from the due date until the total Invoice sum has been paid and, at Photoasia's discretion, invoice any end-user directly for any Reproduction fees payable with respect to Image(s) supplied by or on Your behalf. Your company directors, partners or proprietors agree to accept joint and several liability with respect to all debts incurred by You.

3.3  Cancellation fee and Copyright notice/Credit line omission

Until Photoasia has issued the license for Image use neither party is committed to grant or to acquire any Reproduction rights in any image. After a fee has been agreed and licence issued a firm and binding contract is offered whereby Photoasia is committed to grant Reproduction rights and You to acquire them. If after such issue but before payment, You request cancellation of the Reproduction rights Photoasia may in its discretion cancel subject to You paying a cancellation fee.

Unless otherwise agreed in writing, if any Image(s) Reproduced by the You omits the copyright notice/credit line specified by Photoasia, the Image license fee(s) payable by the You shall be 20% more than that specified on the Invoice.

3.4  Death, Bankruptcy, Receivership…

On Your death or bankruptcy, or in the event of a resolution, petition or order for winding up being made against You, or if a receiver is appointed, or if You are unable to trade because of Your inability to pay Your creditors, Photoasia may at any time thereafter gain immediate access to inspect any records, accounts and books relating to the Reproduction of Photoasia's Image(s) to ensure that the Image(s) are being used only in accordance with the Reproduction rights granted to You and where it is found that the Image(s) are not being used in accordance with the Reproduction rights granted to You, Photoasia may terminate the license and do all things necessary to prevent Your use of the Image(s).

3.5  GST

All Invoices will constitute a Tax Invoice for the purposes of the G.S.T. (Goods and Services Tax) Act 1999 and will separately outline any applicable Australian goods and services tax (GST), which must be paid by Client as part of the Invoice. If You are outside Australia You are not subject to GST.

4.  Additional Reproduction rights for Images

a.        Should You require additional Reproduction rights in any Image, You can revisit the Website and repurchase the desired Image and must specify the additional Reproduction rights required, including the proposed use, period of use, print run, media usage, end user customer, industry, territory and size and position of proposed Reproduction with respect to each Image required. Alternatively You can contact us at Photoasia on +613 94814696 (international) or send an email to sales@photoasia.com.au 

b.        A corresponding Invoice will be emailed or posted to You stating the fees payable and Reproduction rights granted with respect to each Image in which Photoasia grants additional Reproduction rights. Such Reproduction fee(s) as advised by Photoasia to You may vary per Image depending on a number of factors including but not limited to the period of use, print run, media usage, end user customer, industry, territory and size and position of proposed Reproduction.

c.        You acknowledge and agree to the following:

                                 I.      Reproduction rights are strictly limited to the specific use granted by Photoasia with respect to each Image and as detailed on the corresponding Invoice emailed to You.

                               II.      Reproduction and re-use of any Image without the required consent granted by Photoasia constitutes an infringement of copyright by You. Reproduction rights and license to use are only granted on payment of the Invoice.

                             III.      Reproduction rights are granted by Photoasia for each Image solely to You and are not assignable without the prior written consent of Photoasia.

d.        You acknowledge that any Image licensed by Photoasia of a person, including a person well known to the general public may not be used in a manner which can be reasonably construed as that person's endorsement of a product or service, nor may any Image be used in a manner which can be reasonably construed as derogatory, libellous, defamatory or slanderous of that person.

5.  General

a.        Photoasia warrants that it owns or is licensed to supply for Reproduction the Images supplied. Unless specified in writing Photoasia does not warrant to You the existence or validity of model, property or other releases with respect to any Images downloaded by You or supplied on CD-ROM to You. You must satisfy Yourself as to Image suitability, Reproduction quality and caption accuracy and that all necessary rights, consents, permissions and releases have been obtained prior to Reproduction of each Image by You.

b.        To the full extent permitted by law, Photoasia excludes all warranties, statutory, express or implied, from these terms of supply and license, except as expressly set out above. Where any statutory terms may not be excluded, liability in respect of them is limited to repair or resupply of goods, or the supply of services again. These terms are the entire agreement between the parties regarding the Image(s) and any services supplied by Photoasia.

c.        Risk in and responsibility for Images passes to You from the time they are delivered. You shall immediately inform Photoasia in writing of any known loss or misuse of or damage etc. to the Images while in Your possession or that of any third party.

d.        You agree to indemnify and keep indemnified Photoasia from and against any and all loss, damage or liability whether criminal or civil suffered by Photoasia and resulting from any act omission, negligence or default of You or Your agents, principals, customers, clients or contractors, or arising out of the Reproduction of any Image(s), in any manner or for any use or purpose whatsoever by You.

e.        Neither party may assign this Agreement without the prior written consent of the other party.

f.         Amendments, modifications or changes to these terms and conditions are not effective unless agreed in writing by Photoasia and You.

g.        These terms and conditions are governed by the laws of the State of Victoria, Australia.
